1. Scope

Healthy & Fit GmbH (hereinafter referred to as "CrossFit Limmatstadt") operates the CrossFit Limmatstadt gym. By using CrossFit Limmatstadt or purchasing a membership, the athlete accepts these Terms and Conditions. The member is granted co-use of the facilities and services (e.g., gym spaces) of CrossFit Limmatstadt.

2. Membership

Membership is personal and non-transferable.

3. Contract Duration and Termination

The customer selects a membership duration at the time of contract signing (e.g., 1, 3, 6, or 12 months). This choice is binding.

Ordinary or extraordinary termination before the end of the selected contract period is excluded, including in cases of illness, relocation, or professional changes.

The membership ends automatically upon expiration of the selected term. There is no automatic renewal. The customer may purchase a new membership at any time with a duration of their choice.

CrossFit Limmatstadt offers various services and membership types. Services are determined by the type of membership. Services and prices may be changed at any time. Current prices are listed at www.crossfitlimmatstadt.ch.

 

4. Payment

The membership fee is due upon signing or renewal of the contract. Payment may be made by cash, card, Twint, or bank transfer.

 

5. Validity Period

Contract duration is determined by the type of subscription. A 10-session punch card is valid for 3 months. Personal training subscriptions are valid for a maximum of one year from the date of purchase. Unused sessions expire after this period.

6. Non-Utilization / Refunds

Failure to utilize the services of CrossFit Limmatstadt does not entitle the customer to a refund or reduction of the agreed payment. This also applies to the fundamentals course, even if individual classes or the entire course cannot be attended after registration.

Customers are not entitled to compensation or replacement sessions if CrossFit Limmatstadt is unable to provide services due to force majeure (e.g., natural disasters) or insolvency.

 

7. Opening Hours and House Rules

Facilities are open daily during business hours, except on public holidays or due to maintenance, cleaning, remodeling, etc. CrossFit Limmatstadt reserves the right to change its offerings and operating hours. Facilities may be closed for a maximum of 2 consecutive days for seminars or trainings, without any entitlement to a refund.

Members must follow the house rules and staff instructions. Serious or repeated violations of these Terms or staff instructions may lead to a ban from the premises and/or immediate contract termination. In such cases, no refund is provided.

 

8. Membership Suspension

Memberships (subscriptions with a duration of at least 3 months) may be paused up to 5 times or for a total of 5 weeks per calendar year (e.g., for vacation, injury, business travel). Monthly subscriptions and 10-session passes cannot be paused.

 

9. Private Sessions / Personal Training

Private sessions canceled less than 24 hours in advance will be fully charged. Personal training packages are valid for maximum 1 year from the date of purchase. Unused sessions within this period will expire.

10. Transfer of Rights & Relocation

The rights and obligations of this agreement may be transferred by CrossFit Limmatstadt to a legal successor.
Relocation of the gym within the city of Zurich does not entitle members to early termination.

 

11. Liability & Health Disclaimer

CrossFit Limmatstadt and its staff are not liable for any damages suffered by a customer in connection with the use of its facilities, particularly injuries or illnesses resulting from the use of equipment or training. Use of facilities and equipment is at the customer’s own risk.

Given the high-intensity nature of CrossFit training, we recommend all participants consult a physician to confirm fitness readiness before training.

Customers are liable for any damage caused to facilities or equipment through improper use. Parents or legal guardians are liable for their children.

CrossFit Limmatstadt accepts no liability for lost personal items or for items left at reception or stolen from the premises. Insurance is the responsibility of the customer.

 

12. Data Protection

We respect your right to privacy. We collect and store member data only as necessary for membership management. CrossFit Limmatstadt uses services provided by the third-party provider Zenplanner. Accordingly, personal data is shared with Zenplanner. CrossFit Limmatstadt is not liable for any data processing carried out by Zenplanner.

 

13. Photos and Videos

The member consents to the use of training photos/videos on the CrossFit Limmatstadt website and all social media channels. Surveillance video may also be used for safety purposes.

14. Jurisdiction

Swiss law applies. Jurisdiction is the registered office of Healthy & Fit GmbH. The member explicitly waives the right to a legal venue at their place of residence.

15. Amendments to Terms and Conditions

The member acknowledges that CrossFit Limmatstadt reserves the right to amend these Terms and Conditions. Amendments will be communicated in an appropriate manner. No rights may be derived from changes to the Terms and Conditions or house rules.
